29. Purpose Statement
    • To provide vendors and/or businesses of goods and/or services the opportunity to sell on public property at selected City events as provided by the code of ordinances.
    •  To enhance the experience of attendees and guests at selected City events with goods and services not normally provided by the City.
    • To provide and support local vendors and businesses a mechanism to vend on City property in a controlled environment that benefits both parties in an equitable manner.
    • To provide potential revenue streams to help maintain sustainable city run events and programs in a responsible manner.
31. Vendor Information
    • The vendor will be conducting business in connection with the transaction of official government business and/or event in accordance to Chapter 10, Article V, Sec. 10-119.
    • All food vendors must submit a copy of general liability insurance and Tarrant County Health Permit and food handlers certifications with this application.
    • No political campaigning. No tobacco, alcohol or adult themed vendors. City events are family friendly in nature and all solicitation and attire should reflect that.
    • All signage is subject to approval of the City of White Settlement. 
    • The City reserves the right to deny any and all applications and services for goods as deemed necessary by the City; I.E. event cancellations, inclement weather, acts of God, excessive and/or similar type vendors, etc.
    • Vendors will be accepted on a first come basis.
    • Trash bags and trash removal from the cans during the event will be provided by the City staff. Each vendor will be responsible for his or her own trash clean up.
    • No utilities will be provided for vendors.
    • Set up times will be arranged by City Staff and tear down/cleanup will be completed by the vendor immediately following the event.
    • Vendors are required to furnish their own chairs, tables, awnings, umbrellas. Vendors are not allowed to stake their tents into the ground or pavement.
    • A person possessing a license in connection with the above-mentioned defenses is vending goods pursuant to the terms of his license and the applicable rules and regulations governing the license.
35. WAIVER OF LIABILITY, RELEASE, INDEMNIFICATION AND HOLD HARMLESS AGREEMENT

    I, the undersigned, for and in sole consideration of the privilege of participating in certain park and recreational programs sponsored by the City of White Settlement, and recognizing that the programs and activities have some risks to persons and property, do hereby agree to assume the risks and dangers attendant to such activity, including but not limited to property damage and/or personal injury as a result of participating in the programs and/or activities or resulting from the acts of third parties whether caused by errors, omissions, or negligent acts of myself or third parties. 

     I do hereby waive all claims, release, indemnify, defend and hold harmless the City of White Settlement and all of its officials, officers, agents, employees, in both their public and private capacities from any and all liability, claims, suits, demands, expenses of litigation or causes of action which may arise by reason of injury to persons,  or damage to or loss of use to any property occasioned by error, omission or negligent act of myself or any third party with regard to this agreement, and I will, at my own cost and expense, defend and protect the City of White Settlement against any and all such claims and demands.

    I do hereby further agree to indemnify, defend and hold harmless the City of White Settlement and all of its officials, officers, agents, employees, from and against any and all claims, losses, damages, causes of action, suits and liability of every kind, including all expense of litigation, including but not limited to court costs and attorney fees for death, injury to or death of any person, including myself, or for loss, damage to or loss of use of any property, including my own, arising out of or in connection with this agreement.   

    Such indemnity shall apply whether the claims, losses, damages, causes of action, suits or liability arise in whole or in part from the negligence of the City of White Settlement, its officers, officials, agents or employees.   It is the express intention of the parties hereto, both myself and the City of White Settlement, that the indemnity provided for in this paragraph is indemnity by the undersigned to indemnify and protect the City of White Settlement from the consequences of the City of White Settlement’s own negligence, whether that negligence is the sole or concurring cause of injury, death or damage.

     I also assume full responsibility for all medical and emergency expenses in the event of an accident, injury, illness or other incapacity, regardless of whether I have authorized such expenses.

    I also agree that the City, its officials, employees, agents and representatives have the authority to take photos of me as part of City activities.  The photos may be taken and used, including publication, without my express consent or knowledge and without any payment due to me.

    I also agree that I will not use, copy, publish, disclose, or authorize anyone to use or disclose any information or knowledge concerning any matters relating to the business of the City of White Settlement which I may in any way acquire by reason of volunteer work with the City of White Settlement without first obtaining permission from the office of city manager.

    It is further agreed that the execution of this Waiver of Liability, Release, Indemnification and Hold Harmless Agreement will not constitute a waiver by the City of White Settlement of the defense of governmental immunity, where applicable, or any other defense recognized at law or equity.

    I, the undersigned have read this waiver of liability, release, indemnification and hold harmless agreement and understand its terms.  I execute it voluntarily and with full knowledge of its significance.
